Privacy notice for director ID

The director ID privacy notice tells you why the Registrar is collecting your personal information, and who the Registrar may give your information to when authorised.

The Commissioner of Taxation is appointed Registrar under section 1270 of the Corporations Act 2001 and Commonwealth Registrar under section 6 of the Commonwealth Registers Act 2020. The Registrar is responsible for exercising powers and functions for director identification numbers (director IDs) under Part 9.1A of the Corporations Act 2001 and Part 6-7A of the Corporations (Aboriginal and Torres Strait Islander) Act 2006.

The Registrar is authorised to collect the information requested on this application by the following laws:

  • Corporations Act 2001 – in particular, sections 1272, 1272A, 1272B, 1272C and 1272E, and
  • Corporations (Aboriginal and Torres Strait Islander) Act 2006 – in particular, sections 308-5, 308-10, 308-15, 308-20 and 308-30.

The Registrar requires this information to confirm your identity in order to provide you with a director ID.

If you do not provide the information, the Registrar may not be able to process your application for a director ID. If you do not have a director ID, you may be subject to penalties as prescribed by the law.

The Registrar is authorised by the Taxation Administration Act 1953 to request your tax file number (TFN). The Registrar will use your TFN to confirm your identity.

If you do not provide your TFN, it is not an offence, but there may be a delay in processing your application. 

When authorised by law, the Registrar may give your information to other government departments and agencies, including:

  • Australian Taxation Office (ATO)
  • Australian Securities and Investments Commission (ASIC)
  • Australian Charities and Not-for-profits Commission (ACNC)
  • Office of the Registrar of Indigenous Corporations (ORIC)
  • law enforcement agencies
  • federal, state and local governments
  • courts and tribunals
  • certain bodies under the Public Governance, Performance and Accountability Act 2013.

Information that ASIC collects from the Registrar will be used to identify and investigate individuals and to perform enforcement functions.

  • how we will deal with any privacy complaints.
